1. Agreement to these terms
These Terms of Service (“Terms”) form a binding agreement between you and AriesAi (“AriesAi”, “we”, “us”) covering your use of our website, AI-assisted development product, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Your use of the Service is also subject to our Privacy Policy.
2. Eligibility
You must be at least 13 years old (or 16 in parts of the EU) to use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.
3. Your account
You are responsible for your account credentials and for any activity that occurs under your account. Notify us at ai.aries.info@gmail.com if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
When using the Service, you agree not to:
- Break the law or violate the rights of others, including intellectual property and privacy rights.
- Upload, host, or publish images, media, code, or other content you do not own or do not have permission to use.
- Generate or distribute content that is illegal, harmful, harassing, hateful, sexually exploitative of minors, or designed to deceive.
- Attempt to reverse-engineer, scrape, overload, or otherwise interfere with the Service or its underlying infrastructure.
- Use the Service to build a competing AI product, train another model on our outputs at scale, or resell access without permission.
- Bypass safety filters, rate limits, authentication, or any other technical restrictions we put in place.
- Submit prompts that include other people's personal data without a lawful basis to do so.
5. Your content
You retain ownership of the prompts, code, files, images, and other content you submit, upload, or generate (“Your Content”). You grant us a worldwide, non-exclusive licence to host, store, process, transmit, and display Your Content solely to operate, secure, and improve the Service for you.
You are solely responsible for Your Content. By submitting or uploading Your Content, you represent and warrant that:
- You own Your Content, or you have all rights, licences, and permissions necessary to submit, upload, publish, and use it through the Service.
- Your Content does not infringe or violate any third party's intellectual property, privacy, publicity, or other rights, and does not break any law.
- Any images, fonts, media, or other material you upload are free of third-party rights that would prevent their use, or you have obtained those rights yourself.
You can upload media such as images while you build. We store your uploads on our infrastructure so they persist while you work, and they are bundled into the files you download so your published site is self-contained. You are responsible for everything you upload and publish. We do not pre-screen Your Content, but we may remove or disable access to any content we believe violates these Terms or the law, and we respond to copyright complaints as described in our Copyright Policy.
6. AI outputs
The Service uses third-party AI models (such as Anthropic’s Claude) to generate responses, code, and other outputs (“Outputs”). Subject to your compliance with these Terms, you may use Outputs for personal or commercial purposes.
You acknowledge that:
- Outputs are generated probabilistically and may be inaccurate, incomplete, biased, or unsafe.
- Identical or similar Outputs may be produced for other users; we make no exclusivity claim over Outputs.
- You are responsible for reviewing Outputs before relying on them, especially in production, security-sensitive, legal, medical, or financial contexts.
- We do not warrant that Outputs are free of third-party rights claims; you remain responsible for how you use them.
7. Fees and changes to the Service
Parts of the Service are currently free. We may introduce paid plans, change pricing, or modify features in the future. If we charge for a feature you actively use, we will give you reasonable notice before doing so. We may also add, change, or remove features at any time to improve or maintain the Service.
8. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by AriesAi and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
9. Third-party services
The Service relies on third-party providers (for example, authentication, hosting, and AI model providers). Their availability and their own terms may affect your experience of the Service. We are not responsible for third-party services beyond integrating with them.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create risk for us or other users, or if we are required to do so by law. Sections that by their nature should survive termination (for example, IP, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. You use the Service and any Outputs at your own risk.
12. Limitation of liability
To the maximum extent permitted by law, AriesAi will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 50.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence, wilful misconduct, or statutory consumer rights).
13. Indemnity
You agree to indemnify and hold AriesAi harmless from any third-party claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your breach of these Terms or applicable law.
14. Governing law and disputes
These Terms are governed by the laws of Switzerland, without regard to its conflict of laws rules. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland, unless mandatory consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, give you reasonable notice in the product or by email. Continuing to use the Service after the changes take effect means you accept the updated Terms.
16. Copyright complaints (DMCA)
We respect intellectual property rights and expect you to do the same. If you believe content made available through the Service infringes your copyright, please follow the notice-and-takedown procedure in our Copyright Policy. We respond to valid notices by removing or disabling access to the material, and we terminate the accounts of repeat infringers in appropriate circumstances.
